The Contract between us:

When an order is received and you supply your E mail address we will issue an E mail response to acknowledge receipt of your order however this does not constitute acceptance of your order. We must receive full payment for the goods before the order can be accepted. Once payment has been received in full together with postage as applicable we will confirm that your order has been accepted again by e-mail confirming despatch.

Our Right to Refuse Your Order

We reserve the right to refuse acceptance of your order for any reason including, without limitation and whether or not payment has been received by us, if:

  • We have insufficient stock to deliver the goods you have ordered or
  • We do not deliver to your area or
  • One or more of the goods you ordered was listed at an incorrect price due to a typographical error or
  • An error in the pricing information received by us from our suppliers.

If we do refuse your order we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 14 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

Price

The prices, currency, vat and delivery cost payable for goods that you order are as set out in our website.

Right for you to cancel your contract

You may cancel your contract with us for the goods you ordered at any time up to the end of the seventh (7th) working day from the date of order. To cancel your contract you must notify us in writing or e-mail to customerservices@shopforleather.co.uk

If your order has been despatched or if you have received the goods before you cancel your contract then you must send the goods back to our contract address at your own cost. The goods must not be unpack when they are received by you and you must send the goods back to us at our contact address at your own cost and risk within seven (7) days. Proof of postage is recommended and you should consider insurance as no refund or replacement of any payments made in relation to the goods returned will be made until they are back in our possession. The payment card will then be re-credited.

If you cancel the contract but do not return the goods to us in the condition they were in when delivered to you or do not pay the costs of delivery, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.

Delivery of Goods to You

We post all UK orders via standard Royal Mail by first class recorded delivery- the cost is £3.95 for any order size. Certain items depending on their weight and destination may incur an additional charge. We will inform you if this is the case.

Guaranteed next day delivery is charged at £6.95; all orders placed before 12pm Monday to Friday will be guaranteed for the next day. Please note that orders placed on a Saturday for this service will not be delivered until Tuesday.

Delivery will be made as soon as possible after your order is accepted and within 7 working days unless otherwise advised where subject to special order by prior agreement.

We will deliver the goods ordered by you to the address you provided us at the time of the order. It is important that the address given is accurate and that you are solely responsible to take delivery of the goods.

Shopforleather will not be responsible for delays or cancellations where the delivery details supplied by the customer are incorrect. You will become the owner of the goods you have ordered when they have been delivered to you.

Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction. A signature and confirmation of receipt constitutes completion of delivery.

Legal notices and Liability

If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, or fail to be received then (except where you are dealing as a consumer within the meaning of the Unfair Contract Terms Act 1977) we shall have no liability to you unless you notify us in writing at our contact address of the problem within 14 working days of the delivery. Where goods fail to be delivered then you must similarly advise in writing within 14 days of your despatch confirmation for goods not withstanding where goods are specially ordered for delivery at a future agreed date.

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable English law or other statutory rights that may not exclude nor in any way be excluded or limit our liability to you for any death or personal injury resulting from our negligence.

Account Security and Password

It is your responsibility to protect and maintain the confidentiality of your account and password. Shopforleather shall not be liable to any person for any loss or damage which arises as a result of your own failure to protect your password or account.

Indemnity

You agree to fully indemnify us, our directors, employees and all officers agents and suppliers from and against all claims of liability loss or damage and free of any costs or charges arising out of any breach of conditions by you or any liabilities arising out of your use of this website, or the use by any other person accessing the Website using your personal information or your shopping account.

Notices

Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our contact address for shopforleather.co.uk.

Events Beyond our Control

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected to the extent that they are capable of continuing in force without the unenforceable term or condition.

Privacy

You acknowledge and agree to be bound by the terms of our privacy policy.

Third Party Rights

Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act.

Governing law

The contract between us resulting from the use of this website, the website itself and all content herein shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

Entire Agreement

These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy set out the whole of our agreement relating to the supply of the goods to you by us and except where you are dealing as a consumer:

Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us and, save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

Damage to Your Computer

Shopforleather makes every effort to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer. It is your responsibility to ensure the correct equipment is available to use the website and screen out anything that may damage it. Shopforleather shall not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.
